In case we conclude contracts of carriage acting as agents on behalf of the carrier the terms and conditions of our principal`s Bill of Lading and/or standard conditions for carriage of goods apply. Supplemental our services are subject to the General Terms and Conditions for Ship Brokers and Ship Agents in Germany, latest edition. Contracts of carriage on our own behalf as sea carrier are governed by our Bill of Lading conditions. For Freight forwarding services which we conclude on our own behalf we operate exclusively in accordance with the German Freight Forwarders' Standard Terms and Conditions 2017 (hereafter ADSp 2017), unless mandatory law applies. Please note: Section 23 of the ADSp 2017 vary from paragraph 431 of the German Commercial Code (HGB) in terms of liability limitation. In particular, it provides for 2 SDR per kilogram for loss or damage to the goods arising out of multimodal transportation including carriage of goods by sea and when the place of incident is unknown. For all other contracts of carriage, except for carriage of goods by sea and ordered warehousing, a liability limitation of 8.33 SDR per kilogram applies. In addition, the liability is limited to EUR 1.25 million per Damage Case respectively EUR 2.5 million per Damage Event or to 2 SDR per kilogram, whichever amount is the higher. In the case of multimodal transports including sea transport the liability is limited to 2 special drawing rights (SDR) per KG, generally. Attention: In deviation from section 21.2. ADSp 2017 a goods in transit cargo insurance will be covered only on your behalf if you provide us well in time prior to commencement of the transport with written insurance instructions and the required insurance value as well as the conditions needed. Unless otherwise agreed, the place of jurisdiction is Hamburg. Arbitration is excluded. We will send you the ADSp 2017 upon request.
